Thank you for contacting me regarding Virgin America Airlines. You raise some important concerns.
As you know, Virgin America hopes to operate as a low-fare carrier in the U.S., and seeks to begin flying from San Francisco International Airport and John F. Kennedy Airport in New York, before expanding to other cities. The federal Department of Transportation has tentatively rejected Virgin America’s application to receive a domestic operating certificate. The Department raised concerns of substantial foreign control of Virgin America, and maintains that the company will have to revise its ownership structure so that it is 75 percent owned and operated by U.S. citizens.
Virgin has formally responded to the Department, and the agency is reviewing this response. It would be inappropriate for me to intervene in this process at this time, but I will follow this situation closely. If it becomes clear that the Senate should take action on this matter, I will keep your communication closely in mind.
